Scottish PEN response: The Hate Crime and Public Order (Scotland) Bill

Scottish PEN has submitted a response to the Scottish Parliament Justice Committee’s call for views on the Hate Crime and Public Order (Scotland) Bill. While the implications of the Bill are varied, our response focuses on the rights of writers to express themselves freely and without fear.

Scottish PEN has submitted a response to the Scottish Parliament Justice Committee’s call for views on the Hate Crime and Public Order (Scotland) Bill. While the implications of the Bill are varied, our response focuses on the rights of writers to express themselves freely and without fear. We have summarised the main points of our submission below, and you can download a copy of our full submission at the bottom of this page.  

Support for the Bill

‘We know that for many writers, realisation of the right to freedom of expression is put at risk because they live with a fearful awareness (and often, direct experience) of hate crime. This Bill proposes much that could help to defend these groups and increase the diversity of creative works we see from writers in protected groups. However, we are also keenly aware that some offences proposed in the Bill could induce a climate of self-censorship and a suppression of writing that challenges power or subverts societal norms. We hope that our response balances both of these points in a constructive way, with a defence of free expression for all at its heart’.
